TikTok Sues U.S. Government Over Upcoming Ban

The lawsuit claims the recently passed law allows Congress to “circumvent the First Amendment by invoking national security.“

TikTok filed a lawsuit against the U.S. government this week, attempting to block the recently passed law that would ban the application from the U.S. if its Chinese parent company, ByteDance, does not divest it. 

TikTok attorneys claim that “qualified divestiture” is “simply not possible: not commercially, not technologically, not legally.” They argue that the Protecting Americans From Foreign Adversaries Act presented a false choice that is, in effect, a forced ban of the social media application.

The lawsuit went on to state that even if TikTok’s divestment from ByteDance was “feasible,” the law still would be “an extraordinary and unconstitutional assertion of power” that violates the First Amendment by targeting a single company. TikTok said this would set a precedent that would allow Congress to “circumvent the First Amendment by invoking national security and ordering the publisher of any individual newspaper or website to sell to avoid being shut down.”

The lawyers for TikTok also cite the use of the platform by the campaigns of President Biden and members of Congress as proof that the social media app is not a national security threat.
